he right to education in Latin America: a conceptual and empirical analysis in accordance with of the principle of equality

Education as a right plays a significant role in the public agenda of Latin American countries, but despite its high normative recognition, the effectiveness of this right is low. This study includes qualitative techniques to analyze the scope of the right to education in terms of the principle of equality. Quantitative techniques are also used to analyze educational statistics in order to measure the right to education. Firstly, a conceptual approach to the right to education is presented in light of the principle of equality, as it constitutes one of the foundations of human rights. Secondly, a factual analysis of the exercise of the right to education is carried out by studying educational statistical indicators that allow us to compare how effective the distribution of educational opportunities is in the region. Thirdly, with regard to results, inequalities between countries and between primary and secondary education levels are analyzed. The discussion and conclusions raise problematic issues regarding the effectiveness of the right to education in light of various indicators. To complete the factual analysis, some of the consequences of the COVID-19 pandemic, which appear to have exacerbated structural inequalities, are also included.
